While there is no statutory requirement for Employees to provide resignation notice to their Employers under the Employment Standards Act, 2000, there are Common Law rules and obligations for employees to provide reasonable notice of resingation.â

If an Employee fails to provide reasonable notice of resingation, an Employer may have a claim for Wrongful Resignation against the Employee.â

The rule of thumb is to provide the Employer with 2 weeks resgination notice. However, depending on the length of your employement and employment role, this can be increased.â

There are many factors when determining how much reasonable resingation notice one must give, here are a few to consider:â
Is there any contractual obligation for incrased notice through the Employement Agreement or the Employers policies.â
The level of skill and specialization of the position which is being resigned from.â
The length of time it would take for the Employer to find a suitable replacement for the vacant position.
